Court Frees Kano Housewife Accused Of Killing House Help

A Kano State Magistrate Court has vindicated one Fatima Hamza who was accused of killing her house help.

TrackNews Online understands that the 30-year-old housewife was earlier arraigned for being responsible for the death of Khadija Isyaku, her housemaid in Sharada Quarters.

Hamza’s freedom was granted after the Prosecution Counsel, M. S. Ahmad, at the resumption of the court sitting on Wednesday, February 24 presented a piece of legal advice to the court by the state Department of Public Prosecution according to section 376 (6) and 299 (3) of the Administration of Criminal Justice Law (ACJL) 2019 to terminate the First Information Report, TrackNews Online understands.

Ahmad during the presentation urged the court to terminate and discharge the defendant in line with section 259(3) 376(3) of the Administration of Criminal Justice Law (ACJL).

According to him, “There is no single evidence that shows the defendant committed the offence.”

He added that “The legal advice should also be forwarded to the State Police Command and make a proper investigation on the case, invite those involve; if found guilty, they should be charged to court.”

In his ruling, the presiding Judge, Chief Magistrate Ibrahim Khalil, discharged the defendant after terminating the First Information Report based on a piece of legal advice by the Ministry of Justice which found her not guilty of the offence.

“Following the legal advice by the State Department of Public Prosecution in the Ministry of Justice dated February 22, I hereby terminate the FIR and discharge the defendant,” Khalil noted.

On his part, the counsel for the defendant, Ibrahim Chedi, did not object to the legal advice.

TrackNews Online understands that Fatima was charged to court with culpable homicide after reports emerged on January 22 that she beat up her housemaid (Khadija) to a pulp, and as a result died at the Murtala Muhammad Specialist Hospital where she was rushed to for medical examination.
