Osun gov poll: Court strikes out suits against Adeleke, Omisore
SOGBO—TWO pending cases over the forthcoming governorship election in Osun State, were yesterday, struck out by an Osun State High Court sitting in Osogbo, challenging Senator Iyiola Omisore as the governorship candidate of Social Democratic Party, SDP, in the forthcoming September 22, 2018 election.
Similarly, the same court also dismissed a fresh suit challenging Senator Ademola Adeleke as the candidate of the Peoples Democratic Party, PDP, for the Sept. 22 governorship election in the state.
Omisore’s case was struck out following an application for withdrawal of the suit after intervention by some party stakeholders.
At the resumed sitting, yesterday, the applicants’ lawyer, Mr. Olayinka Sokoya told the court that the matter was beyond the internal running of the party but was premised on the constitution of the party.
The case was, however, struck out by justice Oladimeji after settlement out of court by both parties involved in the case.
Case against Adeleke struck out
Similarly, the Presiding Judge, Justice David Oladimeji, dismissed the suit following the plaintiffs’ withdrawal of the case against Senator Adeleke.
At the resumed hearing, on Monday, after a fresh suit seeking an interlocutory injunction restraining Adeleke from parading himself as the candidate of the Osun PDP over alleged forged school certificate, Counsel to the plaintiff, Abdulramon Okunade, told the court that his clients had reached an agreement to withdraw the suit and asked for an adjournment.
But the defence counsel, Mr. Nathaniel Oke, opposed the adjournment, affirming that the case should be dismissed since the applicants had resolved to withdraw the matter.
