Gboyega Awoyinka, a 42-year-old Okada operator, has been remanded in prison by an Ore Chief Magistrate Court for allegedly raping a 39-year-old mentally deranged married woman inside a cocoa farm in Kajola —Ojurin, Ore, Ondo State. The Ondo state police command charged Awoyinka in court with rape on a single count.

Inspector Jimmy Amuda, the police prosecutor, told the court that the defendant, also a farmer, committed the crime on August 25, 2022, at a cocoa farm in Ore, Ondo State. According to Amuda, the defendant had carnal knowledge of one Rhoda Adeboye, a married but mentally deranged woman in the farm at Kajola Ojurin in the state’s Odigbo council area.

“That you, Gboyega Awoyinka, on August 25, 2022, at Cocoa farm at Kajola —Ojurin via Ore in the Ore Magisterial district did unlawfully have carnal knowledge of one Rhoda Adeboye,” the charge read in part. The charges allege that the offenses violate Sections 357 and 358 of the Criminal CodevCap. 37 Volume 1 Laws of Ondo State of Nigeria, 2006. The defendant, however, pleaded not guilty to the charge.

As a result, the police prosecutor requested permission from the court to forward the case file to the office of the Director of Public Prosecutions (DPP) for legal advice. Mr. V. A Akinfe, the defense counsel, did not object to the prosecutor’s request.

The defendant was remanded at the Okitipupa Correctional Centre pending the outcome of legal advice from the DPP, according to the chief Magistrate’s ruling. As a result, Chief Magistrate lkusika adjourned the case until September 30, 2022.
