Mr. Segun Oni, the Social Democratic Party (SDP) governorship candidate in the June 18 election, has warned that the governor-elect, Biodun Oyebanji, risks losing his ostensible victory at the polls if respondents continue to avoid court service as required by law.
Oni, through his legal team, accused Oyebanji and the All Progressives Congress (APC) national leadership of allegedly committing contempt of court, stating that it was against the rule of court for the respondents to resist service, implying that the case could proceed without defense.
Last week, the ex-governor accused Oyebanji, Mrs. Afuye, the deputy governor-elect, and ex-APC national caretaker chairman and Yobe State Governor Mai Mala Buni of making it difficult to serve court processes due to their lack of fixed addresses.
As a result, the petitioner petitioned the Election Petitions Tribunal for an order of substituted service, which the panel’s Chairman, Justice Wilfred Kpochi, granted at the panel’s inaugural sitting on July 25.
Mr. Owonseni Ajayi, one of the senior lawyers, told reporters in Ado-Ekiti over the weekend that the respondents were resisting attempts by court bailiffs to serve them despite the court’s order.
