The National Industrial Court (NIC) sitting in Abuja, has on Tuesday, struck out a suit the National Association of Nigerian Students (NANS) filed to compel the Academic Staff Union of Universities (ASUU), and the Federal Government to call off the seven-month old strike action.

Track News Nigeria understands that the trial judge, Justice Polycarp Hamman, terminated further proceedings in the matter, after it was withdrawn by a factional NANS President, Umar Faruk Lawal.

When the matter came up on Tuesday, Lawal informed the court that he filed a motion for discontinuance.

Though the other two respondents were not represented, counsel to ASUU, Marshal Abubakar, notified the court that he was not opposed to Lawal’s application to withdraw the suit.

Consequently, Justice Hamman struck out the matter.

Recall that after several meetings between ASUU and the federal government failed to yield any concrete result, the government had filed a suit against union at the NIC.

The court, on September 21, ordered university lecturers to resume work.

BUT, ASUU had responded by filing an appeal seeking a stay of execution on the decision of the NIC.
