Election Petition Court dismisses Action Alliance Petition challenging Tinubu, others

The Presidential Election Petition Court seating in Abuja has dismissed the election Petition challenging the emergence of President – Elect Ahmed Tinubu in the 2023 elections.

Justice Haruna Tsamani dismissed the petition following a withdrawal of the petition at the commencement of the pre-hearing by counsel to Action Alliance AA, Mr. Oba Maduabuchi SAN after the matter was mention for hearing.

Maduabuchi told the court that, “I am seeking the withdrawal of the petition in its entirety and prayed that the petition be dismissed.”

Mr. Maduabuchi informed the court that the petitioners have filed a withdrawal notice on May 3.

Meanwhile, following a no-objection stance by all the respondents in the matter, the Justice Haruna Tsammani led five-member panel dismissed the petition.

AA, specifically had in the petition filed at the PEPC on March 16, insisted that though its candidate, Solomon Okanigbuan, was validly nominated to contest the presidential election, he was however unlawfully excluded by INEC.

The party maintained that the presidential election was thus, “invalid for non-compliance with the provisions of the Electoral Act 2022, as amended”.

It argued that Tinubu “was thus not validly elected as his election contravenes the Electoral Act, the 1999 Constitution and INEC Guidelines for the 2023 general elections.”

The petitioners told the court that Major Hamza Al-Mustapha, who was cited as the 4th Respondent, was not a member of the AA and was not sponsored by the party, adding that he did not participate in its presidential primary election.

Speaking in an interview, counsel to Action Alliance AA, Mr. Oba Maduabuchi SAN he acted on the request of the Party.

Also speaking in an interview, the National Chairman Action Alliance Dr. Adekunle Rufai said, “the Party was neither challenging the emergence of Ahmed Tinubu nor the victory of APC, but protesting the process adopted by umpire – INEC.

Our driving force is survival of our country Nigeria as a single entity, revitalization of the already weakened love among our collective nationalities and to build stronger sense of equity, fairness and justice in our electoral Democracy.”
