Appeal court did not order sub-licensing — MultiChoice lawyer breaks silence

Lawyers for MultiChoice Nigeria have dismissed media reports that the Court of Appeal had ordered the company to sub-license some of its channels to Metro Digital Limited, a cable television service provider, as false.

Toyin Pinheiro, Principal Partner at the law firm representing MultiChoice Nigeria, issued a disclaimer yesterday, claiming that the reports were a misrepresentation of the court’s decision delivered yesterday.

“It is a misrepresentation of the Court of Appeal Port Harcourt Division’s judgment delivered on July 13, 2022,” it said. The court only ordered the National Broadcasting Commission, the second respondent, to form a panel to investigate Metro Digital Limited’s complaints within 21 days.

“The Court of Appeal dismissed Metro Digital Limited’s petition for relief, which sought to compel MultiChoice Nigeria Limited to sub-license some channels to Metro Digital Limited.”

“The general public is hereby advised to disregard the inaccurate reporting,” the company said.

Metro Digital Limited filed a complaint with the Federal High Court in Port Harcourt, Rivers State, after MultiChoice denied its request for the sublicensing of some of its channels on the grounds that it did not own the rights to the channels and programs in question.

The Federal High Court dismissed Metro Digital’s case last year on the grounds that it was unable to refute MultiChoice’s claim that it did not own the rights to the requested content.
